Ezflip Data Processing Agreement
This Data Processing Agreement ("Agreement") is entered into by and between Evolutyz IT Services. ("Evolutyz", "Processor", "we", "us", "our") and the user of Ezflip ("User", "you", "your", "Controller"). This Agreement governs the processing of personal data within the Ezflip platform ("Service"), in accordance with applicable country privacy laws and regulations.
1. Purpose and Scope
1.1. The Service is intended for use by individuals at least 13 years of age. By using the Service, you represent and warrant that you meet this requirement.
1.2. The processing shall be carried out strictly for the purposes of providing, maintaining, and improving the Service, facilitating user interactions, and fulfilling legal obligations.
1.3.Evolutyz shall not use or process personal data for purposes beyond those set forth herein.

2. Definitions
For the purposes of this Agreement:
- "Personal Data" refers to any information relating to an identified or identifiable natural person processed through the Service, including data within user-uploaded documents.
- "Processing" means any operation or set of operations performed on Personal Data, including collection, storage, retrieval, use, disclosure, deletion, or destruction.
- "Subprocessor" means any third party engaged by Evolutyz for processing Personal Data.
- "Data Breach" means a breach of security leading to unauthorized access to or disclosure of Personal Data.
- "Service" means the Ezflip platform provided by Evolutyz for creating and sharing digital flipbooks.
3. Roles and Responsibilities
3.1. The User shall act as the Controller of Personal Data and is responsible for ensuring that the Personal Data is collected and processed in compliance with applicable laws.
3.2. Evolutyz shall act as the Processor and shall process Personal Data solely on behalf of the User, subject to the terms of this Agreement.
3.3. Evolutyz disclaims any responsibility for the content of User-uploaded documents and shall not be held liable for any data therein.

4. Categories of Data
4.1 The categories of Personal Data processed include, but are not limited to:
- Contact information (e.g., name, email).
- Content of user-uploaded documents (e.g., text, images).
- Technical data (e.g., logs, usage metrics).
5. Data Security
5.1. Evolutyz shall implement appropriate technical and organizational measures to safeguard Personal Data against unauthorized access, loss, or alteration.
5.2. Such measures include, but are not limited to, encryption, secure data storage, and access controls.
5.3. Evolutyz shall ensure that its personnel authorized to process Personal Data are subject to confidentiality obligations.

6. Data Retention and Deletion
6.1. Personal Data will be retained for 180 days following upload, after which it may be deleted for a guest user unless otherwise requested.
6.2. Users may request manual deletion of their Personal Data by contacting Evolutyz at 📧 support@ezflip.ai.
6.3. Data may be retained beyond this period if required by applicable law or for dispute resolution purposes.
6.4. For any user account that is inactive for a period of 12months, the uploaded documents and associated data shall be deleted after 12 months of inactivity.

7. Sub Processing
7.1. Evolutyz engages cloud service providers for hosting and delivery of the Service.
7.2. Evolutyz ensures that any Subprocessor provides adequate safeguards for the protection of Personal Data.

8. Data Breach Notification
8.1. In the event of a Data Breach, Evolutyz shall notify the User without undue delay, providing:
- A description of the nature of the breach.
- Categories and approximate number of affected individuals and records.
- Potential consequences of the breach.
- Measures taken or proposed to mitigate the breach.
9. International Data Transfers
9.1. Data processed through the Service may be stored or accessed from servers across the world that are set-up/bought/leased by Evolutyz

10. Term and Termination
10.1. This Agreement shall remain in effect for the duration of the User’s use of the Service.
10.2. Upon termination, Evolutyz shall delete or retain Personal Data, subject to applicable legal obligations.

11. Liability
11.1. Evolutyz shall be liable for damages resulting from its failure to comply with this Agreement, subject to limitations under applicable law.

12. Amendments
12.1. Evolutyz may update this Agreement to reflect changes in law or practice. Material changes will be communicated to Users by uploading on to the website.
